NY Landlords vs. NY Tenants .. Ok Who’s Telling The Truth?

NEW YORK — In a city of skyrocketing rents, where tenant advocates charge that landlords are increasingly trying to move tenants out of rent-regulated apartments in order to significantly raise the rents, the landlord-tenant wars are becoming ferocious.

Traditional landlord tactics such as turning off heat and hot water are being joined, housing advocates and tenants say, by taking tenants to court repeatedly on baseless charges, such as nonpayment of rent when rent has been paid or illegal residency even if the tenant has the right to live in the apartment.

These allegations have prompted the New York City Council to consider two bills to allow accusations of harassment to be settled in housing court. One bill would give tenants the right to sue their landlords for harassment. An alternative bill, with less support, would give landlords the right to sue problem tenants for harassment.

All things considered, 2007 wasn’t the worst of times for the Bronx, and there were some high spots that came close to making it the best of times.

So herewith, a final look at some of the major and minor stories of the year that was, and let’s hope it’s all uphill in 2008.

Development - and some growing pains

Filtration flap - That controversial giant underground water filtration project in Van Cortlandt Park continued to grab headlines, starting the year with the winning bidder pulling out of the project, a water leakage problem and cost overruns tripling the price and sending it up to an estimated $3 billion.

Play ball - Work was well underway for a new Yankee Stadium due to open April 2009, but not without continuing debate - about just how much replaced parkland will actually be green, to parking garages with controversial financing and the possibility they will wind up playing a role in Mayor Bloomberg’s Manhattan congestion pricing scheme.

Astonishingly, the nation’s largest city is among the safest. Homicides in New York are expected to fall below 500 this year, fewer than in any year since reliable record-keeping began 44 years ago. Mayor Michael Bloomberg and his police commissioner, Ray Kelly, could easily pat each other on the back and call it a day. Laudably, they have instead pledged to bring crime under control in neighborhoods that have so far eluded success.

The mayor and Mr. Kelly plan to send all 914 officers from the new class of graduated recruits to join other officers assigned to these tough areas. This will essentially double the Operation Impact force, which matches new recruits with seasoned officers and is credited with helping to reduce crime in nearly all categories, including rapes and robberies.

IF it hadn’t been for the biting northeastern wind the other day, you might have thought La Casa del Caffe in Morris Park in the Bronx was actually in Italy instead.

A steady stream of people exclaimed “Ciao!” as they stepped inside the cafe on Morris Park Avenue, its shelves stocked with Italian chocolates, pasta, amaretto cookies and panettone, the traditional Christmas sweet bread. A flat-screen television was tuned to an Italian-language talk show, and a stack of Italian newspapers in the corner blared headlines about AC Milan’s recent victory in the FIFA Club World Cup.

Behind the black granite counter, Anna Agovino steamed milk on a chrome Faema espresso machine. Ms. Agovino, an earthy, olive-skinned woman, came to New York from Salerno 14 years ago with her husband, Domenico, an espresso machine repairman, and their daughters Gemma, Mariangela and Stephany. The choice to move to Morris Park was an easy one for the family.

With the Bronx, like the rest of the city, seeing crime declining to its lowest numbers in decades, 140 brand-spanking-new cops will hit the borough Friday, assigned to specific stubborn trouble spots.

The plan, known as Operation Impact, has been a major factor in stamping out crime hot spots around the city and helping drive crime down to levels not seen since the 1960s.

Citywide, the number of homicides is expected to dip below 500.

The murder count in the Bronx through Sunday was 126.

For the same period in 2006, police listed 146 homicides. That’s a drop of 13.7%.

Overall major crime in the borough is down 3.47% for the year, compared with a 6.33% drop citywide.
