Guilty! The Charge Of Murder For A Bronx Man
The Bronx District Attorney’s office announced today that a has been convicted of murdering a another who had a long history of “bad blood” with one of the defendant’s friends.
Bernard Hinson, 29, of 1365 Teller Avenue, the Bronx, was found guilty on one count of Murder in the 2nd degree in the shooting death of David Bovian, 29, and one count of Criminal Possession of a Weapon in the 2nd degree. Hinson is facing a maximum sentence of 25 years to life imprisonment on the murder charge and up to 15 years imprisonment on the gun charge. Hinson could be facing a term of 40 years to life if consecutive sentences are imposed when he appears before State Supreme Court Justice Megan Tallmer on January 15, 2008 in Part T.
The fatal shooting occurred on April 29, 2004 on the sidewalk in front of 1203 Findlay Avenue. The deceased, David Bovian, was standing with his brother Frazier Bovian and another person when a car drove by with Hinson sitting in the front passenger seat and another man, Damon Ellwood behind the wheel. The jury heard testimony that a few minutes later Hinson walked up behind Bovian and fired three shots, striking him twice in the back and once in the thigh. Frazier Bovian tackled Hinson and wrestled him to the ground. As the two men struggled, Hinson regained control of the gun. When Hinson attempted to shoot the surviving Bovian brother as well the gun jammed. Hinton fled and was seen getting into Ellwood’s car a short distance away.
Witnesses testified that the fatal shooting was the culmination of a long ongoing dispute between Elwood and Bovian, the nature of which was not elicited. Ellwood was never charged in connection with the homicide but is in federal custody awaiting sentencing after pleading guilty to a conspiracy charge related to the trafficking of illegal narcotics.
